Ceno Terms of Service

You must be at least 18 years of age to create an account or use any part of the Service. By registering, you represent that all information you provide, including your date of birth, is accurate and truthful.

You may not use the Service if you have been previously banned or removed from Ceno for violating these Terms or our community guidelines, unless we expressly reinstate your access.

You represent that your use of the Service will comply with all applicable laws and regulations in your country or region of residence.

To access certain features, you must create an account by providing accurate registration information, including a valid email address and password.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether or not authorized by you.

You agree to notify us immediately at service@ceno.love if you become aware of any unauthorized access to or use of your account.

We reserve the right to suspend or terminate any account that provides false, inaccurate, or misleading information, including misrepresenting your age.

Ceno is strictly intended for adults. Individuals under the age of 18 are not permitted to register for or use the Service under any circumstances.

If we become aware that an account has been created or is being used by an individual under the age of 18, we reserve the right to immediately suspend or terminate that account and delete associated data in accordance with our Privacy Policy.

Ceno maintains a zero-tolerance policy toward child sexual abuse and exploitation (CSAE) in any form. Users must never upload, share, request, or distribute content that sexualizes, exploits, or endangers minors, and must never use the Service to groom, solicit, or contact minors.

Any account, content, or communication found to violate our zero-tolerance CSAE policy will result in immediate and permanent termination of the associated account, removal of the offending content, and reporting to the National Center for Missing and Exploited Children (NCMEC) and other relevant law enforcement authorities, as applicable.

Parents, guardians, or any user who becomes aware of suspected child exploitation on Ceno should report it immediately to service@ceno.love and, where appropriate, to local law enforcement.

Ownership. You retain all ownership rights in the content you create, post, or upload to Ceno, including observation logs, community posts, comments, and photographs ("User Content").

License Grant. By posting User Content, you grant Ceno a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt, publish, display, and distribute your User Content for the purpose of operating, promoting, and improving the Service.

Content Standards. You agree not to post User Content that is unlawful, harassing, defamatory, hateful, sexually explicit, violent, infringing, fraudulent, or otherwise objectionable, including content that sexualizes or endangers minors as described in Section 3.

Copyright Compliance. You represent that you own or have obtained all necessary rights to post your User Content and that it does not infringe the intellectual property rights of any third party. If you believe your copyrighted work has been infringed, submit a notice to service@ceno.love including a description of the work, the location of the infringing material, and your contact details.

Moderation and Removal. We reserve the right, but not the obligation, to review, moderate, edit, or remove any User Content at our sole discretion, without prior notice, if we believe it violates these Terms, our community guidelines, or applicable law.

Responsibility for Content. You are solely responsible for your User Content and the consequences of posting it. Ceno is not responsible for the accuracy, completeness, or reliability of any User Content, including community-sourced astronomical observations or advice.

You agree not to harass, threaten, impersonate, or intimidate other users of the Service.

You agree not to use the Service to distribute spam, malware, phishing links, or unauthorized commercial solicitations.

You agree not to attempt to gain unauthorized access to the Service, other users' accounts, or Ceno's systems, including through scraping, reverse engineering, or automated bots.

You agree not to misrepresent your identity, impersonate any person or entity, or create multiple accounts to evade a suspension or ban.

You agree not to use the Service for any illegal purpose or in violation of any local, national, or international law or regulation.

Violation of this Section may result in content removal, warnings, temporary suspension, or permanent termination of your account, at our sole discretion.

Virtual Coins. Ceno offers a virtual currency ("Coins") that may be purchased with real money or earned through in-app activity, and used to unlock premium features such as personalized AI forecasts and Weekly Sky Plans.

No Monetary Value. Coins have no monetary value, cannot be redeemed or exchanged for cash, and are not transferable between accounts or usable outside the Service.

Purchase Processing. All purchases of Coins or premium features are processed through the applicable app store's payment system (such as Apple's App Store). By making a purchase, you agree to the applicable app store's terms and payment policies in addition to these Terms.

Pricing and Availability. We reserve the right to change the pricing, availability, or Coin cost of any feature at any time. Changes will not retroactively affect purchases already completed.

Refunds. All purchases are final and non-refundable except where required by applicable law or the refund policies of the applicable app store. Refund requests must be submitted directly through the app store from which the purchase was made.

Forfeiture. If your account is suspended or terminated for violating these Terms, any unused Coins or premium features associated with that account may be forfeited without compensation.

Dispute Resolution for Purchases. If you believe you were charged in error, contact service@ceno.love with your order details, and we will investigate in good faith, though final resolution of payment disputes may be subject to the applicable app store's policies.

Ceno offers AI-generated features, including Weekly Sky Plans and personalized forecasts, based on the region and sky environment information you provide.

AI-generated content is provided for informational and entertainment purposes only and is not a substitute for professional astronomical, meteorological, or safety advice. You should independently verify weather conditions, local regulations, and site safety before engaging in any outdoor observation activity.

Ceno makes no representation or warranty regarding the accuracy, completeness, or reliability of AI-generated content.

The Service, including its software, design, graphics, logos, trademarks, and all content provided by Ceno (excluding User Content), is owned by Ceno or its licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to compliance with these Terms.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Service, except as expressly permitted by these Terms or applicable law.

The Service may include links to or integrations with third-party services, such as map data providers or payment processors. Ceno does not control and is not responsible for the content, policies, or practices of any third-party service.

Your use of any third-party service linked through Ceno is subject to that third party's own terms and privacy policy.

You may stop using the Service and delete your account at any time through the app settings or by contacting service@ceno.love.

We reserve the right to suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, our community guidelines, or applicable law, or if we discontinue the Service in whole or in part.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination, including Sections 4, 6, 8, 11, 12, and 13, will continue to apply.

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of astronomical or meteorological data.

Ceno does not warrant that the Service will be uninterrupted, error-free, or secure, or that any celestial event predictions, meteor shower forecasts, or AI-generated recommendations will be accurate or complete.

You acknowledge that outdoor stargazing activities carry inherent risks, including risks related to weather, terrain, wildlife, and travel to remote or dark-sky locations, and that you engage in such activities at your own risk.

To the maximum extent permitted by applicable law, Ceno and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service.

To the maximum extent permitted by applicable law, Ceno's total aggregate liability for any claim arising from or related to these Terms or the Service shall not exceed the greater of one hundred United States dollars (USD 100) or the total amount you paid to Ceno in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you, in which case liability will be limited to the fullest extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Ceno and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles, except where mandatory local consumer protection law requires otherwise.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation by contacting service@ceno.love.

If a dispute cannot be resolved informally within thirty (30) days, the parties agree that the dispute shall be resolved through binding arbitration on an individual basis, except where prohibited by applicable law or where you are entitled to bring a claim in small claims court.

To the extent permitted by applicable law, you agree to resolve disputes with Ceno on an individual basis and waive any right to participate in a class action, class arbitration, or representative proceeding.

Nothing in this Section shall limit any non-waivable statutory rights you may have as a consumer under the mandatory laws of your country of residence.

We reserve the right to modify, suspend, or discontinue any feature of the Service, including celestial catalog content, community features, or virtual currency mechanics, at any time, with or without notice.

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may revise these Terms from time to time to reflect changes in our practices, legal requirements, or the features of the Service.

If we make material changes, we will notify you through the app, by email, or by posting an updated Effective Date at the top of these Terms.

Your continued use of the Service after any revised Terms become effective constitutes your acceptance of the revised Terms.

If you encounter content or conduct that violates these Terms, including suspected CSAE, harassment, or fraud, please report it using the in-app reporting tools or by contacting service@ceno.love.

We investigate reports in good faith and may take action including content removal, warnings, suspension, or permanent account termination, at our sole discretion.

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent.

We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable.

These Terms, together with our Privacy Policy and any other legal notices published by Ceno on the Service, constitute the entire agreement between you and Ceno regarding your use of the Service and supersede any prior agreements.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision, and any waiver of any provision will be effective only if in writing and signed by an authorized representative of Ceno.
